Ohio EPA Slams Liberty Casting with Violations Over Stormwater, Housekeeping Failures

DELAWARE, Ohio — The Ohio Environmental Protection Agency has cited two Liberty Casting facilities in Delaware, Ohio, for multiple environmental violations, including failures in stormwater management and reporting, according to notices issued Tuesday.

Inspections conducted July 9 by the Ohio EPA's Division of Surface Water (DSW) at Liberty Casting's Curtis Street and Liberty Technologies Division locations identified a range of infractions related to the company's National Pollutant Discharge Elimination System (NPDES) Multi-Sector General Permit (MSGP) and Stormwater Pollution Prevention Plan (SWPPP).

At the Liberty Casting – Curtis St. facility, located at 407 Curtis Street, six violations were noted. These included an inaccurate notice of intent regarding the number of outfalls, a failure to conduct or document required quarterly visual inspections, and routine facility inspection procedures that did not align with MSGP requirements. The DSW also found that the company had not conducted or reported benchmark monitoring as required. Additionally, the facility lacked proper control measures to minimize the discharge of industrial materials exposed to stormwater, such as uncovered dumpsters and used oil drip trays, and demonstrated poor good housekeeping practices, including spills and unstable air dust collection bags.

The Liberty Casting – Liberty Technologies Division, at 630 Liberty Road, faced seven violations. Common issues with the Curtis Street site included an incomplete site map, failure to perform quarterly visual inspections, and non-compliant routine facility inspection procedures. Specific to this location, the Ohio EPA observed unauthorized non-stormwater discharges, evidenced by flowing water from an outfall during dry weather. The agency also cited a lack of control measures for exposed industrial materials, such as uncovered dumpsters, open oil and paint containers, and an uncontained fuel tank. Poor housekeeping was also noted, with spilled paint, foundry sand, and paint chips found on the property.

Jessica Ulmer-West, representing Liberty Casting, was present for a closing meeting following the inspections, during which high-level findings were summarized.

Liberty Casting has 30 days from the receipt of the violation notices to provide documentation to the Ohio EPA DSW detailing the corrective actions taken or planned. Failure to address the violations could result in administrative or civil penalties, according to the notices signed by Loren Gormley, an environmental specialist with the Ohio EPA DSW.
